Madonna dodges punishment in worn underwear lawsuit

Madonna ducked a legal sanction Thursday for refusing to have her deposition videotaped in her lawsuit over the auction of some of her memorabilia, including a pair of worn satin panties and a love letter from late rapper Tupac Shakur.

The Queen of Pop is suing former pal Darlene Lutz for consigning her 'highly personal items' to the online auctioneer Gotta Have It! Collectibles last summer, claiming the ex-friend did not have permission to sell her property.

Madonna’s lawyers barred Lutz’s videographer from attending her deposition in the case in August.

On Thursday, Lutz’s lawyer asked the judge to punish the 'Vogue' singer for the move.

'[Madonna’s] credibility was called into question a number of times' during the legal grilling, the lawyer, Judd Grossman, told Judge Gerald Lebovits in Manhattan Supreme Court.

For example, Grossman said, he asked Madonna during the deposition about a pair of panties she’d sent to a former lover over 20 years ago that were yanked from the auction block when she sued Lutz.

'Do you have any good-faith basis to allege that my client, Darlene Lutz, took these underwear from you?' as the singer has alleged, Grossman pressed.

'I do not,' Madonna admitted.

She also conceded that fan-club letters and snapshots from a Miami bachelorette party that are at issue in the suit had previously been published, according to Grossman.

'[Madonna] was visibly uncomfortable during the deposition. There were periods of time when she closed her eyes, struggling to find an answer,' Grossman said.

But her behavior during the questioning is forever lost to history - and to a jury - because the deposition was not recorded, Grossman argued.

So should the case go to trial, the jury won’t be able to fully asses her credibility, he said.

Madonna’s attorney, Brendan O’Rourke, countered that he believed that the judge had told the parties there would be no videotaped depositions. The judge said he couldn’t recall either way.

O’Rourke added that Lutz’s counsel couldn’t point to one specific instance of perjury in Madonna’s testimony.

Judge Lebovits said that recorded depositions are not the norm, before declining to sanction Madonna.

'I would say that they’re exceptionally atypical,' the judge declared.

Lutz is asking the judge to toss the case based on Madonna’s alleged admissions that many of the items are not, in fact, personal.

25 Years Later, Madonna’s ‘Sex’ Book Is Still Pop’s Most Radical Moment

Twenty-five years ago, Madonna put the world in a trance with the release of Sex. Well, she put some of the world in a trance: During its first day in stores, the $50 coffee-table book, which lived up to its carnal title, sold 150,000 copies, and it soon topped The New York Times Best Seller list. Of course, because it was mainstream art promoting libidinous pleasure, a puritanical outcry followed. Many critics, cultural theorists and fans alike found the BDSM-themed photo collection scandalizing, even repulsive. In their eyes, Madonna, who already faced accessions of overexposure following a decade of chart-topping provocations, had crossed the line.

Today, Sex is still the most radical career move a pop star has ever made.

During Madonna’s imperial phase - the ephemeral period in an artist’s career when everything turns to commercial gold - she sang about teenage pregnancy, introduced the famous cone bra, burned Christian crosses, simulated masturbation on an arena tour and made a video so prurient that even the youth-centric MTV refused to air it. That was child’s play.

The publication of Sex - on Oct. 21, 1992, one day after its companion album 'Erotica' arrived to mixed reviews - marked the moment Madonna’s priorities graduated from making you dance to making you horny. Michael Jackson had been grabbing his crotch for years, and Prince wore an assless pantsuit to the 1991 MTV Video Music Awards, but women were only allowed to push so many buttons. The competing female pop stars of the 1980s couched their sexuality in other aesthetics: punk camp (Cyndi Lauper), androgyny (Annie Lennox), anthems about respect (Janet Jackson), love-hungry wholesomeness (Whitney Houston). For Madonna, however, there was a continuum between 'Like a Virgin,' the 1984 single that sparked her first brush with controversy, and 'Erotica,' a concept album about fornication, conceived in the shadow of the conservative Reagan era and the ongoing AIDS crisis.

My night with Madonna (and Sean Hughes)

Journalist Tim Cooper wrote this article about the late comedian Sean Hughes, and how they both ended up waiting to meet Madonna:

Back in the late 1990s I used to run into Sean Hughes all the time at parties. He was a Perrier Award-winning stand-up comedian and team captain on Never Mind The Buzzcocks who would go to the opening of an envelope, so long as it included a free drink. I was the Showbusiness Correspondent of the Evening Standard so I was often there too.

Such was the case when we both found ourselves in a room at the ICA waiting to meet Madonna one night in November 1999.

Madonna had expressed an interest in seeing the band Sneaker Pimps and, unbeknown to most of the audience (but not me and Sean, who were in on it), had sequestered the upstairs area of the music venue so that she could watch them without having to mingle with the plebs - me and Sean, and all the paying punters. The first most people knew of that was when we were all herded out of the bar and into the downstairs auditorium before the gig began.

We then waited, muttering darkly, while security men blocked the exits for Madonna and her then-boyfriend Guy Ritchie, riding high with his film Lock, Stock and Two Smoking Barrels, to ascend the stairs to the balcony and take their seats in the front row. It was like the Royal Box at Wimbledon: all that was missing was a regal wave from Her Madgesty to signal to the band that she was ready for her command performance to begin.
